Personal Data Protection Law (KVKK) Information Notice

DEFINITIONS

In this information notice, the following terms mean:

Personal Data: Any information relating to an identified or identifiable natural person;
Personal Data Protection Law (“KVKK”): Personal Data Protection Law No. 6698, which entered into force upon publication in the Official Gazette on 7 April 2016;

Data Processor: A natural or legal person who processes Personal Data on behalf of the data controller under the authority granted by that controller;
Data Controller: A natural or legal person who determines the purposes and means of processing Personal Data and is responsible for establishing and managing the data recording system;

These definitions apply throughout this notice.

DATA CONTROLLER

Under the KVKK, the personal data you share as a contact, member, donor, scholarship recipient, intern, supplier, visitor, grant recipient, award recipient, beneficiary, changemaker, contestant, program partner, or employee will be assessed within the stated scope by the YamanHosting legal entity, designated as the data controller.

PURPOSE OF PROCESSING PERSONAL DATA

Under Articles 4, 5, and 6 of the KVKK, your personal data will be:

Processed lawfully and fairly;
Accurate and, where necessary, up to date;
Processed for specified, explicit, and legitimate purposes;
Relevant, limited, and proportionate to the purposes for which it is processed;
Retained for the period required by applicable legislation or necessary for the purpose of processing.

Your data will be processed in accordance with these principles in connection with the YamanHosting activities listed below.

YamanHosting's activities include:

Providing cloud servers, physical servers, and server hosting services;
Providing and operating software and program services.

Personal data processed within this scope is retained for 5 years under the relevant legislation. If neither party brings legal proceedings during this 5-year period, the data is destroyed within 90 days after the period ends.

TRANSFER OF PERSONAL DATA

Under Articles 8 and 9 of the KVKK, your personal data may be transferred, for the purposes listed above and within the conditions and purposes of Personal Data processing, to third parties considered necessary for YamanHosting to continue its activities: program partners, collaborating institutions, suppliers, donors, managers, legally authorized public institutions and bodies, and legally authorized private-law persons.

METHOD AND LEGAL BASIS FOR COLLECTING PERSONAL DATA

YamanHosting may collect your personal data through:

Website registration and application forms;
Website contact forms;
Website newsletter subscription forms;
Website support forms.

Through these and similar channels, and on various legal grounds, your data may be collected, processed, and transferred for the purposes stated in this Information Notice so that YamanHosting can continue its activities, in accordance with the fundamental principles of the KVKK and the personal data processing conditions and purposes specified in Articles 5 and 6.

RIGHTS OF THE PERSONAL DATA SUBJECT

Under Article 11 of the KVKK, everyone has the right to apply to the data controller regarding their own data to:

Learn whether their personal data is being processed;
Request information if their personal data has been processed;
Learn the purpose of processing and whether the data is being used for that purpose;
Know the third parties to whom personal data is transferred domestically or abroad;
Request correction of personal data that has been processed incompletely or inaccurately;
Request deletion or destruction of personal data under the conditions set out in Article 7 of the KVKK;
Request that actions taken under items (5.) and (6.) be communicated to third parties to whom the personal data has been transferred;
Object to a result that is adverse to them arising from analysis of the processed data exclusively by automated systems;
Request compensation for damage suffered as a result of unlawful processing of personal data.

If you contact YamanHosting through the support system regarding the 9 rights listed above, a response will be provided, depending on the nature of your request, within no more than 15 (FIFTEEN) business days.
